A judge in Philadelphia has turned down a request by the city’s liberal district attorney to block a $1 million-a-day giveaway that Donald Trump supporter and tech mogul Elon Musk started last month to boost voter turnout in swing states.
Philadelphia Court of Common Pleas Judge Angelo Foglietta issued a one-page order Monday afternoon denying a request for an injunction sought by District Attorney Larry Krasner. He alleged that the payouts by Musk’s America PAC amounted to an illegal lottery under Pennsylvania law.
Foglietta did not immediately offer a rationale for his decision, which followed a hearing earlier in the day that extended for several hours. At that court session, it appeared that the suit might be moot.
Krasner was not seeking damages or any financial penalty against Musk or the PAC. Arguments at the hearing suggested any injunction might have no effect since the giveaway was slated to end by Election Day and Musk’s attorney said the final recipients are from Arizona, not Pennsylvania.
