Former Trump campaign head Paul Manafort dropped his civil suit challenging special counsel Robert Mueller’s authority the day before his trial on bank and tax fraud charges began.

Manafort filed Monday to drop his appeal of a ruling that tossed out his civil suit against Mueller, challenging the scope of his investigation and claiming that it was overly broad.

U.S. District Judge Amy Berman Jackson ruled earlier this year that the civil suit “is not the appropriate vehicle” for Manafort to raise issues with Mueller, and that he “will have the opportunity to challenge any defect in the prosecution in the trial court or on direct appeal.”

The filing came one day before Manafort’s Virginia trial on bank and tax fraud charges began on Tuesday, the first criminal trial in Mueller’s probe of Russia’s 2016 election meddling and any possible coordination with the Trump campaign.
