President Trump’s personal lawyer said the president cannot obstruct justice, despite arguments from Democrats that special counsel Robert Mueller is building a case for obstruction.

“[The] president cannot obstruct justice because he is the chief law enforcement office under [the Constitution’s Article II] and has every right to express his view of any case,” John Dowd told Axios.

A weekend tweet from Trump about his former national security adviser Michael Flynn prompted questions about whether Trump knew Flynn had lied to the FBI about his conversations with Russia’s ambassador before he fired him.

Trump tweeted that he “had to fire General Flynn because he lied to the Vice President and the FBI. He has pled guilty to those lies. It is a shame because his actions during the transition were lawful. There was nothing to hide!”

Dowd said Sunday he drafted the controversial tweet and sent it to White House social media director Dan Scavino.

“I’m out of the tweeting business,” he said. “I did not mean to break news.”

Still, Dowd said it is “ignorant and arrogant” for anyone to assert that Trump’s tweet admitted obstruction of justice.
