Attorneys for Lindsey Graham said he’ll fight a subpoena issued in Georgia for his testimony — and expects to prevail.

His lawyers say he is merely a witness in the ongoing Fulton County investigation.

What happened: In a statement issued by his attorneys, Sen. Lindsey Graham (R-S.C.) vowed to go to court to fight a subpoena issued out of Fulton County, Ga., looking into possible criminal interference in the state following the 2020 elections.

Graham’s attorneys Bart Daniel and Matt Austin from Nelson Mullins Riley & Scarborough LLP made the following statement:

– “As Chairman of the Senate Judiciary Committee, Senator Graham was well within his rights to discuss with state officials the processes and procedures around administering elections. Should it stand, the subpoena issued today would erode the constitutional balance of power and the ability of a Member of Congress to do their job. Senator Graham plans to go to court, challenge the subpoena, and expects to prevail.”

The attorneys further claimed the Fulton County investigators are “engaged in a fishing expedition and working in concert with the January 6 Committee in Washington.” They claimed any testimony from Graham would be immediately shared with the panel in Washington.

Graham is “simply a witness” and not the subject nor target of the investigation in Fulton County, the attorneys said.
